It establishes mandatory requirements for certain electrical and electronic products placed on the market within the Eurasian Economic Union (EAEU).

In terms of its objectives, the regulation is comparable to the European RoHS Directive (Restriction of Hazardous Substances). RoHS (TR EAEU 037/2016) and the European RoHS Directive are, however, separate regulatory frameworks with their own scopes, requirements and Conformity Assessment procedures. Existing EU RoHS compliance therefore does not automatically replace the TR EAEU 037/2016 conformity assessment requirements.

TR EAEU 037/2016 is intended in particular to:

restrict the use of certain Hazardous Substances in electrical and electronic equipment,

reduce risks to people and the environment,

establish uniform requirements within the EAEU,

and ensure that the affected products comply with the specified substance restrictions.

The scope of TR EAEU 037/2016 covers various categories of electrical and electronic equipment. Where they fall within the specific scope of the regulation, these include, for example:

electrical household appliances,

computers and electronic equipment,

telecommunications equipment,

office equipment,

electrical and electronic tools,

lighting equipment and light sources,

certain electrical cables and wires,

and other electrical and electronic equipment covered by the Technical Regulation.

Whether a specific product falls within the scope of TR EAEU 037/2016 must be assessed on the basis of its technical characteristics, intended purpose and the scope of the regulation. Not every electrical or electronic component is automatically subject to TR EAEU 037/2016.

The regulation restricts in particular the following hazardous substances:

lead (Pb),

mercury (Hg),

cadmium (Cd),

hexavalent chromium (Cr VI),

polybrominated biphenyls (PBB),

and polybrominated diphenyl ethers (PBDE).

For lead, mercury, hexavalent chromium, PBB and PBDE, the maximum permitted concentration is generally 0.1% by weight in homogeneous material; for cadmium, it is generally 0.01% by weight. At the same time, the regulation provides for specific requirements and exemptions for certain applications.

Depending on the product and the available supporting documentation, evidence of conformity may be based, among other things, on the following documents and assessments:

material and substance information,

technical evidence provided by the Manufacturer,

a Supplier Declaration or other suitable supplier documentation,

test and analysis results,

a Test Report or other relevant test documentation,

and other suitable technical evidence.

Laboratory analyses may be required if the available documentation is insufficient to reliably demonstrate compliance with the substance restrictions. The type and scope of the required evidence must therefore be determined on the basis of the specific product and the available documentation. Where laboratory testing is required, it may be carried out by an appropriately qualified Testing Laboratory.

An essential part of the Conformity Assessment is the Technical Documentation. It must contain the information required to assess the product and its conformity with the requirements of TR EAEU 037/2016.

The Proof of Conformity under TR EAEU 037/2016 is generally provided in the form of an EAC Declaration. The applicable declaration scheme and the required evidence depend on the provisions of the Technical Regulation and the specific product configuration.

For many electrical and electronic products, TR EAEU 037/2016 is not the only applicable Technical Regulation. Depending on the product, additional requirements may apply at the same time, in particular:

TR CU 004/2011 on the safety of low-voltage equipment,

TR CU 020/2011 on the electromagnetic compatibility of technical equipment,

and, for certain machinery and electrical equipment, TR CU 010/2011 on the safety of machinery and equipment.

Therefore, as part of the Product Classification, it should be determined which Technical Regulations (TR EAEU / TR CU) apply to the specific product.

Following successful completion of the required Conformity Assessment and fulfilment of the applicable requirements, the prescribed EAC Marking must be observed. The marking indicates the conformity of the product with the EAEU Technical Regulations applicable to that product.

Incomplete material information, missing supplier documentation, insufficient test reports or incorrect product classification may complicate the registration of the EAC Declaration or result in additional testing being required.

For manufacturers and exporters, it is therefore advisable to assess the scope of TR EAEU 037/2016 and the available material and supplier documentation at an early stage. Particularly for complex electrical and electronic equipment with numerous components, a structured assessment of the materials used can significantly reduce the effort required for the Conformity Assessment.

We support manufacturers and exporters in implementing the requirements of TR EAEU 037/2016. This includes assessing the scope of application, Product Classification, evaluating available material and supplier documentation, preparing the Technical Documentation, coordinating required testing and carrying out the procedure for the registration of the EAC Declaration.

TR EAEU 037/2016 – RoHS is the Technical Regulation of the Eurasian Economic Union on the restriction of the use of Hazardous Substances in electrical and electronic equipment.
