Product Liability in the EAEU
Product liability in the Eurasian Economic Union (EAEU) refers to the legal responsibility of manufacturers, importers, applicants and distributors for damages caused by defective or non-compliant products. For companies exporting products to Russia, Belarus, Kazakhstan, Armenia or Kyrgyzstan, product liability is a critical aspect of regulatory risk management. Missing or incorrect conformity documentation may not only prevent market access but can also result in significant legal and financial consequences.
Within the EAEU, products must comply with the applicable Technical Regulations of the EAEU (TR EAEU / TR CU). Products placed on the market without a valid EAC Certificate, registered EAC Declaration or proper EAC marking are considered non-compliant. In the event of accidents or safety incidents, this may lead to governmental enforcement actions, penalties, import restrictions or civil liability claims.
Product liability is particularly important for safety-related products such as machinery, pressure equipment, electrical systems, explosion-protected equipment and industrial installations. In these sectors, authorities and market surveillance bodies require complete technical documentation, traceable safety assessments and reliable conformity evidence.
A particularly important role is assigned to the applicant or importer established within the EAEU. Since foreign manufacturers are often not permitted to act directly as applicants, the local representative usually assumes regulatory responsibility toward authorities and market surveillance organizations. Clear contractual and regulatory allocation of responsibilities is therefore essential.
Technical documentation is one of the key elements of product liability protection. This includes risk assessments, hazard analyses, test reports, safety assessments, operating instructions and records of performed testing and certification procedures. Incomplete or incorrect documentation is one of the most common causes of regulatory issues and liability risks.
Authorities within the EAEU may also carry out market surveillance activities. These include product inspections, sample testing, document requests and product recalls in cases of safety deficiencies. Companies must therefore be able to demonstrate continuous compliance with applicable regulatory requirements.
In practice, liability risks often result from incorrect product classification, insufficient certification procedures, improper product marking or modifications to products without renewed regulatory assessment. Continuous regulatory monitoring is especially important for complex industrial systems and serial production projects.
