Importer

An importer is the company or legal entity that imports products into the customs territory of the Eurasian Economic Union (EAEU) and places them on the market for the first time. For foreign manufacturers, the importer plays a critical role because many conformity assessment procedures within the EAEU require a locally registered entity. Especially for EAC declarations, only an applicant or declarant established within the EAEU may usually act as the responsible party.

The Eurasian Economic Union includes Russia, Belarus, Kazakhstan, Armenia and Kyrgyzstan. Products may only be imported and distributed within this common market if they comply with the applicable Technical Regulations of the EAEU (TR EAEU / TR CU). The importer therefore carries significant responsibility for the regulatory compliance of imported products.

The importer’s obligations include ensuring that all required EAC certificates, EAC declarations or state registrations are available. In addition, the importer must verify that the EAC marking has been correctly applied and that technical documentation, operating instructions and accompanying documents comply with EAEU requirements.

The importer is also responsible for proper customs clearance procedures. This includes correct product classification according to TN VED EAEU customs codes, complete customs documentation and consistency between import documents and conformity assessment records. Incorrect or incomplete documentation frequently leads to customs delays or rejection of imported goods.

In many cases, the importer simultaneously acts as the applicant or declarant during the EAC conformity assessment process. As a result, the importer assumes not only organizational responsibilities but also legal liability toward authorities and market surveillance bodies within the EAEU.

Clear contractual and regulatory coordination between manufacturer and importer is particularly important. In practice, unclear responsibilities are among the most common causes of certification issues, customs problems and market surveillance risks.
