Proof of Conformity

Proof of Conformity refers to a document confirming that a product complies with the applicable regulatory requirements. Within the Eurasian Economic Union (EAEU), the EAC Certificate and EAC Declaration are among the most important conformity documents. They are issued or registered, respectively, as part of the prescribed EAC Certification and EAC Declaration procedures.

The type of Proof of Conformity required depends in particular on the following factors:

Proof of Conformity must be distinguished from the technical documents on which the conformity assessment is based. Depending on the product and procedure, these may include:

The type and scope of these documents depend on the respective product, applicable regulations and prescribed procedure. The same documents or tests are therefore not required for every product.

Product Testing may also be required as part of Conformity Assessment. The results are documented in test records and provide a technical basis for assessing Product Compliance.

Proof of Conformity must be clearly attributable to the product concerned. The following information is particularly relevant:

  • Manufacturer and, where applicable, production site,
  • product designation, type and model,
  • covered product variants or series,
  • applicable Technical Regulations,
  • commodity classification codes under TN VED EAEU,
  • validity period and other conditions of the conformity document.

A formally valid conformity document cannot automatically be used for other or merely similar products. The actual product version must correspond to the product assessed and described in the document. Clear Product Identification is therefore particularly important.

Subsequent changes to design, materials, components, technical characteristics or production conditions may affect the applicability of existing conformity documents. In the event of relevant changes, it must be determined whether an additional assessment, modification of the documentation or a new Conformity Assessment is required.

Proof of Conformity is particularly relevant for:

Missing, invalid or inapplicable conformity documents may, depending on the circumstances and national regulations, result in:

  • problems with customs clearance,
  • delays in market access,
  • objections from the competent authorities,
  • additional testing or Certification Procedure,
  • restrictions on imports or product distribution,
  • further regulatory measures.

In addition to formal validity, the current Conformity Status must also be considered. An EAC Certificate or EAC Declaration must be valid in the relevant register and remain applicable to the product version actually manufactured or supplied.

Consistency between the conformity document, the actual product and the underlying Technical Documentation is an essential requirement for legally compliant market access within the EAEU.

We support manufacturers, exporters and importers with EAC Certification and EAC Declaration, as well as obtaining and verifying the required conformity documents. Our services include regulatory Product Classification, assessment of existing documents, compilation of the required Technical Documentation, coordination of necessary testing, and cooperation with testing laboratories and certification bodies.
